Notice is also hereby provided pursuant to Subsection 1601(a) of the Second Class Township Code, as amended and codified, 53 P.S. § 66601(a), that the Board will also consider adoption of the Ordinance at its regularly-scheduled public meeting to be held on MONDAY, JUNE 09, 2025, at the Township’s administrative building commencing immediately after the conclusion of the above-described public hearing.
The Ordinance is enacted pursuant to the authority granted to the Board by Sections 2304 and 2305 of the Second Class Township Code, as amended and codified, 53 P.S. §§ 67304-67305, which authorize the Board to vacate public roadways located wholly or partially within the Township after due notice to all property owners affected thereby and the holding of a public hearing thereon. The following constitutes the title and brief summary of the Ordinance’s provisions in reasonable detail prepared by the Township’s Solicitor in accordance with Subsection 1601(a).

The purpose of the Ordinance is to vacate and abandon the entirety of South (S) Kistler Court which, in turn, comprises a portion of Township Road 553. The Ordinance contains a brief legislative history citing the authority of the Board to exercise the power of street vacation, stating the purpose of the Ordinance, and describing the notice provided by the Township to property owners abutting S Kistler Court. The Ordinance vacates the entirety of S Kistler Court as depicted and described, respectively, in the engineering drawing and legal description which are attached to the Ordinance as Exhibit “A.” The Ordinance also directs the Township Manager to cause the filing of a copy of the Ordinance with the Clerk of the Court of Common Pleas of Lehigh County and empowers the Township Manager to execute any instruments or documentation, upon request of an owner of land abutting S Kistler Court, which may be necessary to establish title to the land underlying the vacated roadway. The Ordinance generally repeals all prior, inconsistent Township ordinances to extent of any inconsistency, contains a savings clause, and provides for an effective date of five (5) days after adoption or as otherwise provided in Article XXIII of the Second Class Township Code.
Complete copies of Ordinance No. 2025-6 may be examined or obtained at the Township’s administrative building located at 2175 Seipstown Road, Fogelsville, Pennsylvania 18051, during normal business hours, 7:30 A.M. to 5:30 P.M., Monday through Thursday.
